Using the service of the store www.fr-sports.com implies acceptance of these terms and conditions.

The online store operating at www.fr-sports.com is owned by FR SPORT GROUP SP. Z O.O. VAT ID: 9472006581, KRS: 0000942717, located at ul. Morgowa 1a/328, 91-223 LODZ POLAND, phone: +48 690 953 027.

Definitions used in the rest of the Terms:

Online store - the store operating at www.fr-sports.com, offering goods via the Internet.

Order fulfillment time - the time the online store sets aside to complete the order and send it for shipment.

Business days - days of the week from Monday to Friday, excluding statutory holidays.

Buyer - an individual making a purchase in the Online Store.

Payment processing entity - an external entity facilitating payments using electronic transfer, bank transfer, or credit card.

Courier - an external entity delivering purchased goods to the address specified by the buyer in the order. The customer may choose the courier during the ordering process.

Store headquarters - the location where customer orders are prepared.

I Offer

  1. Information on the pages of the Online Store does not constitute an offer within the meaning of the Civil Code.
  2. By placing an order through the website fr-sports.com, the Buyer agrees to purchase selected goods under the terms defined in the description of the product.
  3. All goods offered by the Online Store are brand new, free from defects, and legally introduced to the Polish market.

II Placing orders

  1. The condition for using the Store is reading the Terms and accepting its conditions.
  2. Orders through the website www.fr-sports.com can be placed around the clock.
  3. Placing an order is equivalent to entering into a sales agreement with the Online Store.
  4. The Buyer places an order by going through the following points:
  • selecting ordered products
  • choosing the method of delivery and payment
  • indicating the delivery address, optionally: data for which an invoice should be issued
  • confirming the order with the acceptance of the Online Store's regulations

The Buyer can change the order or cancel it until the order is executed (that is, until the order is sent to the Client). The sales agreement is concluded in Polish.

III. Order fulfillment

  1. The order fulfillment time does not include the time needed to deliver the shipment by the Courier.
  2. The delivery time depends on the selected method of delivery.
  3. In the case of an order consisting of goods with different fulfillment times, the order may be executed within the longest of the specified times.
  4. Payment by transfer extends the fulfillment time by the time needed to account for the transfer.
  5. If it is not possible to fulfill the order, the Online Store may withdraw from the order within thirty days from the day of its conclusion.
  6. If due to the absence of goods in stock and the problem with importing goods it will be impossible to execute the order within the specified time, the Online Store undertakes to contact the Buyer (by email provided by the Buyer or by telephone), and together with the Buyer make further arrangements regarding the order.
  7. In the case of choosing by the customer the method of payment by transfer or credit card, the order fulfillment time is counted from the day the seller's bank account or clearing account is credited.

IV Availability of goods

  1. The presence of products in the offer of the Online Store does not equate to its availability and the possibility of fulfilling the order.
  2. The description of individual products contains information about the availability of goods and the estimated time of order fulfillment.
  3. The absence of the ordered goods in the stock of the Online Store prevents the realization and delivery of the order.
  4. The maximum shipping time for ordered products is 30 days.

V Payment Methods

  1. Payments for ordered products can be made via electronic transfer, bank transfer, or credit card. The order is processed after the payment has been registered by the bank or the payment processing entity (PayU S.A.).
  2. Cash payment is also possible by selecting cash on delivery or by paying at the time of personal order collection.
  3. The entity providing online payment services is PayU S.A.
  4. Available payment forms for credit card payments include: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.

VI Proof of Purchase

  1. By accepting the Terms, the Client consents to the issuance and transmission of invoices in electronic form by the Seller in accordance with the Regulation of the Minister of Finance dated July 14, 2005, on the issuance and transmission of invoices in electronic form, as well as the storage and provision of these invoices to the tax authority or tax inspection body (Journal of Laws 2005, No. 133, item 1119).
  2. The Online Store also has the right to issue and send invoices in paper form.
  3. The online store guarantees the authenticity of the invoices.
  4. The seller is not responsible for incorrect data provided by the Buyer at registration, as appropriate for issuing a VAT invoice.
  5. The Client is entitled to withdraw consent in accordance with § 3, paragraph 4 of the regulation by a written declaration of intent to the address: FR SPORT GROUP SP. Z O.O., ul. Morgowa 1a, 91-223 or electronically to the store's email address orders@fr-sports.com
  6. If the desire to receive an invoice is not expressed, the store may issue an individual purchase receipt in the form of a fiscal receipt to individual customers.

VI Proof of Purchase

  1. By accepting the Terms, the Client agrees to the issuance and transmission of invoices in electronic form by the Seller in accordance with the Minister of Finance Regulation of July 14, 2005, on the issuance and transmission of invoices in electronic form, as well as the storage and sharing of these invoices with the tax authority or the tax inspection authority (Journal of Laws 2005, No. 133, item 1119).
  2. The Online Store also has the right to issue and send invoices in paper form.
  3. The online store guarantees the authenticity of the invoices.
  4. The Seller is not responsible for incorrect data provided by the Buyer at registration, as appropriate for the issuance of a VAT invoice.
  5. The Client is entitled to withdraw consent according to § 3 par. 4 of the regulation by a written declaration of intent to the address: FR SPORT GROUP SP. Z O.O., ul. Morgowa 1a, 91-223 or electronically to the store's email address orders@fr-sports.com.
  6. If the desire to receive an invoice is not expressed, the store may issue a fiscal receipt as a proof of purchase to individual customers.

VII. Prices

  1. The prices listed in the Online Store are provided in EURO and include VAT.
  2. For the Buyer, the binding price is the price of the goods at the time of placing the order.
  3. The Buyer bears the cost of the selected delivery method according to the Online Store's price list available in the "Time and Costs of Delivery" section.
  4. Upon selecting the form of delivery and payment, the Buyer gains access to information about the total value of the order.
  5. The Online Store reserves the right to change the prices of products in the offer, to announce and withdraw promotional actions and sales, and to make changes in the range of products available in the Online Store.

VIII. Delivery Cost

  1. The delivery costs are defined in the “Time and Costs of Delivery” section. They are automatically added to the order amount after selecting the delivery method and payment.
  2. The delivery costs listed in the price list apply to orders fulfilled within European Union. For orders sent abroad, the shipping cost is determined individually.

IX. Receipt of Parcels

  1. The Buyer is required to check the condition and conformity of the goods in the presence of the Courier. In the event of any damage or shortages, a report should be made (using the form provided by the courier).
  2. In the case of non-consumer sales, complaints regarding mechanical damage incurred during transport will only be considered if the defect is discovered in the presence of the courier company’s employee.

X. Right to Withdraw from the Agreement

  1. In accordance with the Act of May 30, 2014, on consumer rights (Journal of Laws 2014.827), a Buyer who is a private individual has the right to withdraw from the sales agreement without stating a reason within 14 days from the date of receipt of the order. The withdrawal can be made for all or part of the ordered goods.
  2. The Customer may also exchange the goods for another within 14 days from the date of receipt of the order. If the exchanged goods have a lower price than the goods the Buyer ultimately wants to receive, the Buyer is required to pay the difference to the Online Store. Conversely, the Buyer may seek a refund of the price difference to a designated bank account.
  3. To withdraw from the agreement or exchange goods, the customer is required to fill out a form available in the "Returns and Complaints" section.
  4. To maintain the deadline for withdrawal from the agreement or exchange, the customer must send the package containing the exchanged/returned goods and the aforementioned form within 14 days from the date of receipt of the order.
  5. The Customer bears the direct costs of returning the goods.
  6. In the event of withdrawal from the agreement, the Online Store refunds the cost of the returned product to the Customer. Delivery costs are not refundable. The refund of funds is made promptly after receiving the returned goods, no later than 14 days from the day of receiving the return of the goods.
  7. The refund payment is made to the bank account indicated in the form. In case it is necessary to refund the money for a transaction made by the customer with a credit card, the seller will make the refund to the bank account associated with the customer’s credit card.
  8. The Customer may be required to cover the costs of any reduction in the value of the returned products if it results from using them in a way other than checking the characteristics and functionality of the goods.
  9. The right to withdraw from the agreement does not apply to the consumer in the cases listed in Art. 38 of the Act on Consumer Rights, specifically in the case where the subject of the agreement is goods produced to the customer's special order, unavailable in regular sale.
  10. Returned products should be sent back in an unchanged condition, as far as possible in the original packaging.
  11. Returns should be sent to the address: FR SPORT GROUP SP. Z O.O., ul. Morgowa1A, 91-223 Łódź.
  12. Returns should not be sent via Inpost Parcel Lockers, DPD or GLS.
  13. The Online Store does not accept returns sent by cash on delivery package/letter.
  14. In the event that a refund is necessary for a transaction made by the customer with a credit card, the seller will refund the money to the bank account associated with the customer’s credit card.

XI. Product Complaints

  1. The products offered by the Online Store are offered without defects.
  2. Goods purchased in the Online Store can be complained about through the store itself.
  3. The statutory right of liability for defects of sold goods (warranty for defects) applies within the scope specified in Art. 556 and Art. 556[1]-556[3] and subsequent of the Civil Code.
  4. The Online Store accepts responsibility under the warranty if a physical defect is found within two years from the date of delivery of the goods.
  5. To file a complaint, one must fill out the Complaint Form available in the "Returns and Complaints" section and send the goods along with the attached Form to FR SPORT GROUP SP. Z O.O., ul. Morgowa 1a, 91-223 Łódź.
  6. The consideration of the complaint occurs within 14 business days from the date of delivery of the complained products to the above address.
  7. If a defect or irregularity of the product not due to the Customer's fault is found, the Online Store is obliged to repair the product defect, replace the product with one free of defects, or refund the cost of the product.
  8. The Customer will be promptly informed about the outcome of the submitted complaint.
  9. If the defect arose as a result of incorrect use of the product by the customer, the Online Store has the right to consider the complaint negatively.
  10. The extent of the Online Store's liability to the Customer, in the case of detection of a defect in the sold product, is determined by the applicable legal provisions.
  11. Complaints should not be sent via Inpost Parcel Lockers.
  12. The Online Store does not accept complaints sent by cash on delivery package/letter.
  13. The basis and scope of the Seller's liability to the Customer if the sold Product has a physical or legal defect (warranty) are defined by generally applicable legal provisions, particularly in the Civil Code.

XII. Information Regarding the Processing of Personal Data of Store Users

  1. To use the Online Store, it is necessary for the Customer to provide their personal data. By accepting the store's regulations, the Customer agrees to the processing of personal data.
  2. The personal data administrator of the Store is FR SPORT GROUP SP. Z O.O.. The administrator processes customers' personal data in accordance with the General Data Protection Regulation of April 27, 2016 ("GDPR").
  3. Customers' personal data are processed, among others, in the following scope:
    1. to fulfill orders placed by the Customer;
    2. to create and maintain an account in the Online Store;
    3. to carry out activities related to the returns and complaints process;
    4. if the Customer gives special consent, to send commercial information via email. Such information may relate to the current store offer, promotional actions, etc. This consent is not necessary to make purchases in the Online Store;
    5. to display personalized marketing messages during shopping, based on the analysis of purchases made by the store's customers;
    6. for the needs of conducting internal statistics of the Online Store;
    7. for the Online Store to pursue claims or defend against claims directed against it, and to prevent or detect frauds.
  4. Refusal to provide personal data is equivalent to the impossibility for the Customer to make purchases in the Online Store.
  5. The consent to the processing of personal data can be revoked by the Customer at any time. This does not affect the legality of the processing of personal data before the withdrawal of consent.
  6. The Online Store provides data to entities involved in the fulfillment of orders placed by the Customer.
  7. Personal data can be processed by the Online Store no longer than for 10 years from the day of giving consent to the processing of personal data.
  8. The Online Store applies appropriate security measures reducing the risk of leakage, disintegration, or destruction of personal data.
  9. Under the rules set out in the GDPR, the Customer has the following rights in connection with the processing of their personal data: the right to access data, their updating, the right to request the transfer of data, their deletion, to object to the processing of data, and the right to request the limitation of their processing.
  10. The Customer has the right to file a complaint with the President of the Personal Data Protection Office in connection with the processing of personal data by the Online Store.

XII. Information Regarding the Processing of Personal Data of Store Users

  1. To use the Online Store, it is necessary for the Customer to provide their personal data. By accepting the store's terms and conditions, the Customer agrees to the processing of personal data.
  2. The administrator of the personal data of the Store's Users is FR SPORT GROUP SP. Z O.O.. The administrator processes customers' personal data in accordance with the General Data Protection Regulation (GDPR) of April 27, 2016.
  3. Customers' personal data are processed in the following scope:
    1. to fulfill orders placed by the Customer;
    2. to establish and maintain an account in the Online Store;
    3. to conduct activities related to the returns and complaints process;
    4. if the Customer provides special consent, to send commercial information via email. Information may concern the current store offer, promotional actions, etc. This consent is not necessary for making purchases in the Online Store;
    5. to display personalized marketing messages during shopping, based on an analysis of purchases made by the store's customers;
    6. for internal statistics of the Online Store;
    7. for the Online Store to pursue or defend against claims directed against it, and to prevent or detect fraud.
  4. Refusal to provide personal data results in the inability of the Customer to make purchases in the Online Store.
  5. Consent to process personal data can be revoked by the Customer at any time. This does not affect the lawfulness of the processing based on consent before its withdrawal.
  6. The Online Store shares data with entities involved in fulfilling the orders placed by the Customer.
  7. Personal data may be processed by the Online Store no longer than 10 years from the day of giving consent for processing.
  8. The Online Store applies appropriate security measures to reduce the risk of data leakage, disintegration, or destruction of personal data.
  9. Under the regulations of GDPR, the Customer has the following rights in relation to the processing of their personal data: the right to access data, update them, the right to data portability, their deletion, to object to processing, and the right to request the restriction of processing.
  10. The Customer has the right to lodge a complaint with the President of the Office for Personal Data Protection regarding the processing of their personal data by the Online Store.

XIII. Final Provisions

  1. The products presented on the pages of the Online Store fr-sports.com do not constitute an offer within the meaning of the Civil Code.
  2. For matters not specified by these terms and conditions, the provisions of the Civil Code or other legal acts shall apply accordingly.
  3. All disputes related to services provided by FR SPORT GROUP SP. Z O.O. within fr-sports.com will be settled by the competent authorities.
  4. The entity providing online payment services is Blue Media S.A.
